How long can I stay in Spain without becoming a resident?
HOME’S NEVER BEEN SO CLOSE
Foreign visitors can stay in Spain for a maximum of 183 days per year without being considered tax residents. If this limit is exceeded, the person will be considered to have established residence in the country and will be responsible for complying with all corresponding tax obligations.
The length of stay is counted as the period of time that the person has remained in the country, whether continuously or discontinuously, in a period of 12 months.
It is important to note the difference between residence for immigration purposes and tax residence. Many residence permits require a stay in the country of more than 183 days per year in order to be renewed, which may result in a consideration as a tax resident. It is therefore crucial to understand the tax implications before establishing residency in Spain.
